If you are not sure how you should proceed, what <span class=\"negrita\">documentation<\/span> you need and whether you need a <span class=\"negrita\">sworn translation<\/span> or not, you are in the right place to shed some light on this transaction. Anyone purchasing property in Spain needs to complete a series of formalities and obtain a series of documents prior to sale. Therefore, we would like to give you some advice on <span class=\"negrita\">buying property in Spain: formalities and documentation<\/span>.<\/p>\n\n\n\n<p class=\"texto_justificado\">As a foreign national, you need to obtain the <span class=\"negrita\"><em>NIE<\/em><\/span> (<span class=\"negrita\">Spanish Identification Document for Foreigners<\/span>), which will provide you with a personal number for exclusive use only. You may apply for it either from abroad or in Spain.<\/p>\n\n\n\n<p class=\"texto_justificado\">Likewise, you will also need to open a <span class=\"negrita\">Spanish bank account<\/span>, as notarial fees, property purchase price and other expenses will be often paid from this account.<\/p>\n\n\n\n<h2 class=\"titulo_h2 wp-block-heading\">The process of purchasing property in Spain<\/h2>\n\n\n\n<p class=\"texto_justificado\">Firstly, you make an offer to the seller. If accepted, you need to sign together with the seller a <span class=\"negrita\"><em>contrato privado de compraventa<\/em><\/span>or a <span class=\"negrita\"><em>contrato de arras<\/em><\/span> (a <span class=\"negrita\">preliminary private contract<\/span>), by which the buyer and the seller <span class=\"negrita\">commit<\/span> themselves to the <span class=\"negrita\">purchase<\/span> and <span class=\"negrita\">sale<\/span> of the property. Then, you need to pay a <span class=\"negrita\">deposit<\/span> which usually accounts for 10% of the purchase price. The difference lies in the fact that, in a <span class=\"negrita\"><em>contrato de arras<\/em><\/span>, the buyer can decide not to buy the property, therefore losing the deposit, or the seller can decide not to sell it, therefore reimbursing twice the deposit sum; whereas in the case of a <span class=\"negrita\"><em>contrato privado de compraventa<\/em><\/span>, this is not foreseen unless one of the parties to the contract breaches it.<\/p>\n\n\n\n<p class=\"texto_justificado\">This <span class=\"negrita\">contract <\/span>needs to indicate the <span class=\"negrita\">debts<\/span> of the <span class=\"negrita\">property<\/span>. For instance, when the property is subject to a <span class=\"negrita\">mortgage<\/span> or a <span class=\"negrita\">land charge<\/span>. This information is available in the <span class=\"negrita\"><em>Registro de la Propiedad<\/em><\/span> (<span class=\"negrita\">Land Registry<\/span>). In order to get access to it, you may apply for a <span class=\"negrita\"><em>Nota Simple<\/em><\/span> (<span class=\"negrita\">non-certified note<\/span> recording ownership) either in person at the Land Registry or online.<\/p>\n\n\n\n<p class=\"texto_justificado\">If you wish, you may arrange any <span class=\"negrita\">mortgage<\/span> you require. Moreover, since 2010, you need to sign a <span class=\"negrita\">document<\/span> provided by the real estate agency in order to justify the origins of the money you will be using to purchase the property. This is done with the aim of <span class=\"negrita\">preventing money laundering<\/span>. In this regard, the Notary Public will need to check the property <span class=\"negrita\">ownership<\/span> and <span class=\"negrita\">statement of any debts<\/span>.<\/p>\n\n\n\n<p class=\"texto_justificado\">Later on, an <span class=\"negrita\"><em>escritura de compraventa<\/em><\/span>(<span class=\"negrita\">deed of sale<\/span>) is signed before a <span class=\"negrita\">Notary Public<\/span>. This is normally done two or three months after the <span class=\"negrita\"><em>contrato de arras<\/em><\/span>. In general terms, the buyer is responsible for the <span class=\"negrita\">expenses<\/span> arising from the public deed. <span class=\"negrita\">Notary fees<\/span> range from 600 to 875 euros in Spain. The same applies to <span class=\"negrita\">registration fees<\/span>, for which the buyer is responsible and range from 400 to 650 euros. If needed, you may also make use of an <span class=\"negrita\">agency<\/span> to complete all the <span class=\"negrita\">formalities<\/span> related to <span class=\"negrita\">submission of documents<\/span> before official bodies and tax returns. After signing the deed, you need to pay all <a href=\"https:\/\/www.housesinspain.com\/blog\/property-taxes-in-spain\"><strong>tax<\/strong><\/a> applicable to <strong>Spanish properties<\/strong>.<\/p>\n\n\n\n<h2 class=\"titulo_h2 wp-block-heading\">What documents do you need to bring with you before the Notary Public?<\/h2>\n\n\n\n<p>As a buyer, you need to bring your <span class=\"negrita\"><em>NIE<\/em> <\/span>with you, as well as the following <span class=\"negrita\">documents<\/span>:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Payment proof<\/li><li><em>Contrato privado de compraventa <\/em>or <em>contrato de arras<\/em><\/li><\/ul>\n\n\n\n<p class=\"texto_justificado\">Note that Spain also offers a <span class=\"negrita\">Golden Visa Programme<\/span> for foreign property owners. If you invest more than \u00a3500,000 in Spanish properties, you will get a <span class=\"negrita\">residency visa<\/span>.<\/p>\n\n\n\n<h2 class=\"titulo_h2 wp-block-heading\">Appointing a representative in Spain<\/h2>\n\n\n\n<p class=\"texto_justificado\">You may consider <span class=\"negrita\">appointing an attorney<\/span> to act on your behalf in Spain from the beginning. In order to do this, you must grant a <span class=\"negrita\">power of attorney<\/span>. Although this can be done in Spain, it is more <span class=\"negrita\">convenient<\/span> and common to do so in your <span class=\"negrita\">home country<\/span>. This way, the attorney appointed by you can act on your own behalf to complete the <span class=\"negrita\">formalities<\/span> of the purchase process.<\/p>\n\n\n\n<h2 class=\"titulo_h2 wp-block-heading\">Do you need a sworn translation?<\/h2>\n\n\n\n<p class=\"texto_justificado\">Yes. Any document written in a foreign language that is required for completing <span class=\"negrita\">formalities<\/span> in Spain when buying property must be <span class=\"negrita\">translated<\/span>.
